Born into an Italian-American family, he was the fourth of five children. His cousin is actress and singer Patti Lupont. He began writing plays at the age of nine. One of Fontana's plays was staged at the college where he studied. After graduating from college in 1973, he moved to New York.
In the early 1980s he came to television. His first work as a screenwriter was the series "St. Elsver". He worked on the series "Prison Oz", "Slaughter Section" and many others, for which he was repeatedly awarded prestigious awards. Fontana has written articles for publications such as The New York Times and Esquire. His plays have been staged in theaters in New York, San Francisco and Buffalo. He is a member of the Playwrights Guild and the Producers Guild of America.
Fontana is friends with Law & Order creator Dick Wolfe. One of the characters in Law & Order is named after him - detective Joe Fontana, played by Dennis Farina.
